Discussion on another list suggested that the profesor in question teaches mainly intro biology. Thus, he seems like a somewhat odd choice of recommender in the first place. Perhaps the student was deliberately seeking confrontation. On the other hand, a more tactful approach by the professor would be advisable. The idea of writing a letter recommending against the student sounds like a good solution, although that is probably not a guarentee against lawsuits.
